An application by the Husband in the US Courts for parenting time during the pendency of the divorce action in Poland would get little traction. Moreover, the ultimate decree regarding the children would be binding on the US Court according to the Hague Convention. (Conversely, if Husband filed first in the USA, he may very well get a different outcome regarding custody and parenting time, and indeed, a separate ruling on support as the cost of living in Poland is substantially lower as the dollar is 4:1 with Polish currency). at said, once the Court entered the divorce in Poland as to the issue of children, custody, support and fault (where if fault is proven, the Husband would be responsible for all fees; not the case in the USA), the division of assets would be the next step. Should the Wife choose to file in Poland, the division of assets would commence. ose assets located in Poland could be divided by way of consent, where the parties can agree on the division and codify said agreement in front of a notary public and then file the uncontested agreement, or, if no deal is possible, the Court would ultimately decide on the division by way of a trial, with the appropriate appraisals and expert testimony. But what about the assets in the USA? at is where the saga continues. e divorce decree, which would need to reference the open and unresolved issue of undistributed assets in the USA, must be domesticated. Once domesticated, the Husband would apply with the US court to complete the asset distribution. His wife, still residing in Poland, would need to secure representation in the US.
